Maintaining Status vs. Unlawful Presence for NIVs and PRs

Presentation Description: In this session we will discuss maintaining lawful status, unlawful presence, and other common issue that arise while trying to lawfully remain in the US. The presenters will address issues that frequently arise for Fs, Js, other nonimmigrants and permanent residents.

Learning Objectives:

  • Distinguish between what is maintenance of status and what is unlawful presence and when each concept applies to F, J, and other NIV statuses.
  • Will understand the different consequences associated with the two concepts and their future implications for an individual's immigration options.
  • Attendees will learn how to flag these two issues so they know when to alert students and scholars to potential consequences.
